Abstract [Fr]

Partant du constat des risques auxquels les mineurs sont exposés dans le monde numérique, la contribution est divisée en deux parties. Tout d'abord, les motivations qui sous-tendent la nécessité de restreindre la liberté des mineurs dans le monde numérique sont analysées : la cyberintimidation, l'exploitation commerciale et économique des mineurs, ainsi que les menaces constantes et profondes à l'intégrité et à la dignité des mineurs. Une attention particulière est également accordée aux moyens de protection, en premier lieu le rôle joué par les parents, le réseau scolaire et les interventions civiles et pénales elles-mêmes, telles que la loi n° 2023-566 du 7 juillet 2023, qui fixe à 15 ans l'âge minimal pour s'inscrire sur les plateformes sociales. Dans la deuxième partie, des solutions d'équilibre sont recherchées dans la relation complexe entre l'autodétermination des mineurs et leur protection dans le monde numérique.

Starting from the risks faced by minors in the digital world, the contribution is divided into two parts. Firstly, it analyses the reasons why it is necessary to restrict the freedom of minors in the digital world: cyberbullying, the commercial and economic exploitation of minors and the constant and profound threats to the integrity and dignity of minors. Particular attention is also paid to the means of protection, in particularthe role of parents, the school network and civil and criminal measures such as law 2023-566 of 7 July 2023, which sets the minimum age for registration on social platforms at 15. The second part looks at how to strike a balance in the complex relationship between the self-determination of minors and their protection in the digital world.
